Please read these Terms of Service ('Terms') carefully before using the App (the 'Service') operated by Picky ('us', 'we', or 'our').
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Picky as Service Provider
The User is aware that the use of the Service is without any responsibility for Picky, as Picky is only providing the service to enable Users to search, view information, review and read reviews on cosmetic and skincare products. Picky is a Service provider only, and we are not obliged to provide any background check or qualification and no approval procedure towards the Users and/or the content of the Platform.
Picky has not reviewed, and cannot review, all of the material posted to the App, and cannot therefore be responsible for that material’s content, use or effects. By operating the Service, Picky does not represent or imply that it endorses the material there posted, or that it believes such material to be accurate, useful or non-harmful.
The Service may contain content that is offensive, indecent, or otherwise objectionable, as well as content containing technical inaccuracies, typographical mistakes, and other errors. The App may also contain material that violates the privacy or publicity rights, or infringes the intellectual property and other proprietary rights, of third parties. Picky disclaims any responsibility for any harm resulting from the use by Users.
The User’s Obligations
In order to gain access to the functionalities of the Service, the User has to sign up and register as a User of the Service.
The User must at all times:
- Avoid transmitting any content that is offensive, inappropriate or illegal, or otherwise in conflict with these Terms.
- Avoid posting any content that infringes or violates another person’s rights (including intellectual property rights, and rights of privacy and publicity).
By submitting content to our Service, you grant Picky a world-wide, royalty-free, transferable, sub-licensable and non-exclusive license to reproduce, reformat, copy, distribute, modify, adapt and publish the content. You grant us the right to use the name or username that you submit in connection with Your content. By submitting contents to our Service, you grant Picky a world-wide, royalty-free, transferable, sub-licensable and non-exclusive license to commercially use, reproduce, reformat, copy, distribute, display, make a derivative work, modify, adapt, transmit, broadcast, or publish your contents, and to make your contents available to third parties designated by Picky for any of the aforementioned use, and agree not to assert any and all Moral Rights related to the submitted contents against Picky or any third party receiving such contents from Picky. By submitting contents to our Service, you also grant us the right to commercially use the name or username provided with your contents, and such commercial use include, but is not limited to, providing the submitted name and username to a third party.
Medical Disclaimer
Picky offers information on products based on their ingredients and formulation and our users also offer information and opinions on Picky. However, this in no way is a substitute for professional medical prevention, diagnosis, or treatment. Please consult with your dermatologist, physician, pharmacist, or health care provider before using any products, supplements or tools suggested by anyone on this site. Only your healthcare provider, dermatologist, personal physician, or pharmacist can provide you with advice on what is safe and effective for your unique needs or diagnose your particular medical history.
Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Governing Law
These Terms shall be governed and construed in accordance with the laws of District Court of Seoul, Republic of Korea, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 15 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
Language
This agreement was originally written in English (US). To the extent any translated version of this agreement conflicts with the English version, the English version controls.
